This policy explains how personal information is collected, used, disclosed, stored, and protected when you use karastephens.ca, submit a website form, subscribe to updates, or communicate with Kara about real estate services.

This policy applies to this website and website-generated inquiries. If you become a client, additional privacy notices, consents, brokerage policies, agreements, and legal requirements may apply.

Personal information collected

The information collected depends on how you use the website.

  • Information you provide: your name, email address, phone number, preferred contact method, real estate interests, inquiry details, showing preferences, property address, home-search criteria, questionnaire answers, and newsletter consent.
  • Technical and usage information: IP address, browser and device information, referring page, pages visited, form source, cookie preferences, and campaign information included in a link. Optional Google Analytics information is collected when you allow Analytics. Google Ads and HubSpot tracking information is collected when you allow Marketing. When you choose to access imported CREA DDF® listings, the listing section also records the listing identifier, DDF® destination identifier, a View event, a random browser identifier, and referring page for CREA’s required listing measurement. The website does not send your form answers or your IP address as CREA analytics event parameters.
  • Real estate information: if you work with Kara, information about a property, listing, search, offer, transaction, or representation relationship may be collected from you, a brokerage, a real estate board or association, The Canadian Real Estate Association (CREA), public records, or another authorized source.

How personal information is used

  • To respond to an inquiry, arrange a showing or consultation, and understand how Kara may be able to help.
  • To prepare for a buyer or seller conversation using the information you choose to provide in a questionnaire.
  • To provide requested real estate services after the nature of the relationship has been established.
  • To deliver a newsletter, market update, or related real estate information when you have expressly subscribed. You may unsubscribe at any time.
  • To operate, secure, troubleshoot, and improve the website, prevent spam or misuse, and maintain a record of website submissions.
  • To understand website use when you allow Analytics, and to measure campaign performance and website activity when you allow Marketing.
  • To provide CREA’s required measurement of imported DDF® listing-page views after you accept the separate listing-content agreement.
  • To meet brokerage, real estate board or association, regulatory, professional, legal, insurance, accounting, and record-keeping obligations.
  • To list, market, search for, evaluate, and complete real estate transactions when authorized and applicable.

Consent and your choices

Personal information is collected, used, and disclosed with your consent, unless applicable law permits or requires otherwise. Your consent may be express, such as selecting the newsletter consent box or accepting analytics cookies, or implied when the purpose is clear from your request, such as using your contact information to reply to you.

Access to imported CREA DDF® listings is conditional on accepting the separate listing-content agreement and the required listing measurement described in this policy. This measurement is limited to listing-page views and is kept separate from optional Google Analytics and HubSpot tracking. If you do not accept, or if you delete the listing-access cookie, the imported listings section will ask you to accept again before access.

You may withdraw consent for future use where permitted by law. Withdrawal does not affect uses already authorized, and some information may still need to be retained or used to meet legal, regulatory, brokerage, or transaction obligations. Cookie choices can be changed using the privacy preferences control on the website. See the Cookie Policy for more information.

Contacting Kara and agency relationships

Submitting a form, completing a questionnaire, requesting a showing, or contacting Kara does not by itself create a client, agency, or representation relationship. Please do not send confidential information until Kara has confirmed whom she represents and any required disclosure has been provided. If a representation relationship is established, Kara’s professional duties, including applicable duties of confidentiality, will apply.

When information may be shared

Personal information is not sold or rented. It may be shared only as reasonably required for the purposes described in this policy, including with:

  • RE/MAX Kelowna and authorized brokerage personnel;
  • website hosting, security, email delivery, form-processing, customer relationship management, and analytics providers, including HubSpot for configured enquiry and newsletter delivery, SendGrid for website email delivery, Google for consented analytics and advertising measurement, and HubSpot for consented website tracking;
  • real estate boards and associations, CREA, REALTOR.ca, MLS® systems, and data distribution services when authorized and applicable, including CREA’s required measurement of imported DDF® listing activity;
  • other real estate professionals, lawyers or notaries, mortgage professionals, inspectors, appraisers, photographers, government bodies, regulators, and other participants in a real estate matter when authorized or required; and
  • a person or organization where disclosure is permitted or required by law, including to prevent fraud, protect rights or safety, or respond to lawful process.

MLS®, REALTOR.ca, and DDF® information

When a property is listed, searched, marketed, or sold through an MLS® System, information may be collected, used, retained, and disclosed through the applicable real estate board or association, brokerage, CREA, REALTOR.ca, and CREA’s Data Distribution Facility (DDF®), in accordance with the listing agreement, applicable privacy notices and consents, and governing rules. Certain property and transaction details may constitute personal information.

MLS® listing content displayed on this website may be supplied by CREA’s DDF® and is also subject to the separate Terms of Use and listing-content notice presented before access to the listings section. After that notice is accepted, the website reports required listing-page views to CREA using the listing identifier, DDF® destination identifier, a View event, a random browser identifier, and referring page. The random identifier is stored for about 30 days. This reporting does not include your form answers or add your IP address as an analytics event parameter.

Service providers and processing locations

Some website service providers may process or store website inquiry information outside British Columbia or Canada. Information in another jurisdiction may be subject to that jurisdiction’s laws. Real estate transaction records are handled in accordance with applicable brokerage, regulatory, and legal storage requirements.

Retention

Personal information is kept only as long as reasonably needed for the identified purpose, a legitimate business or professional need, or an applicable legal, regulatory, brokerage, insurance, or record-retention requirement. Information that is no longer required is securely deleted, destroyed, or anonymized. Real estate transaction records may need to be retained by the brokerage for prescribed periods.

Safeguards

Reasonable administrative, technical, and physical safeguards are used to protect personal information against unauthorized access, collection, use, disclosure, copying, modification, disposal, or similar risks. No internet transmission or storage system can be guaranteed to be completely secure.

Access, correction, and complaints

You may request access to personal information held about you or ask that inaccurate information be corrected. Kara may need to verify your identity before responding. Access may be limited where permitted or required by law, including where disclosure would reveal another person’s personal information or confidential commercial information.
